We have been involved in many environmental and toxic tort litigation matters in a number of different jurisdictions. Our attorneys have represented several corporate clients with significant potential environmental exposure. We have represented clients who have been designated as Potentially Responsible Parties ("PRPs") by the United States Environmental Protection Agency, New Jersey's Department of Environmental Protection, the Pennsylvania Department of Environmental Resources, and/or the New York Department of Environmental Conservation. In such matters we have aided clients in negotiating and litigating with the relevant agencies or parties over clean-up plans, site remediation, and cost recovery. We have been involved with both traditional litigation methods and the use of alternate dispute resolution.
In addition to defending clients who are alleged to be PRPs in clean-up and cost recovery actions, we have represented clients in claims against their insurance carriers seeking indemnity and reimbursement of costs and fees incurred in connection with environmental liabilities. We are currently handling a multi-million dollar litigation against several dozen insurance companies for clean-up costs and defense expenses. We have successfully negotiated settlements with insurance carriers whereby the carriers paid substantial sums in connection with our clients' environmental liabilities.
Our attorneys have negotiated agreements of sale, lease agreements, professional service contracts, and access agreements. We have performed due diligence for corporate and real estate transactions on behalf of lenders, purchasers, and sellers. Our attorneys have assisted clients in obtaining air, water and land use permits and approvals. The firm has also provided a wide variety of legal advice to clients regarding compliance with numerous state and federal environmental laws and regulations.
